Terms of Service – DinghyFleet Platform

1. General Provisions
These Terms of Service govern the use of the DinghyFleet platform, available at www.dinghyfleet.com, operated by Adam Sieczkowski Software, with registered office at Czaple 269, 80-298 Gdańsk, Poland, NIP: PL5833037544 (“Service Provider”).
The platform enables Users to browse and book boats operated by independent providers (“Operators”) for short-term use, especially on an hourly basis.
DinghyFleet does not provide charter or transport services. The full responsibility for executing the trip lies with the Operator. The platform serves as a technical intermediary.
2. Definitions
Platform / Service – the DinghyFleet online platform.
User – a natural or legal person making a boat reservation through the platform.
Operator – an independent service provider responsible for the charter.
Reservation – a booking placed and paid for by the User.
Deposit – an upfront payment of 10% of the total booking value.
Remaining Balance – the remaining 90% of the booking amount, automatically charged later.
3. Access and Use
No account creation is required to use the platform.
Reservations can be made as a guest after providing necessary contact and payment information.
4. Booking and Payment Process
All payments are processed online through Stripe.
A 10% deposit is charged at the time of booking.
The remaining 90% will be automatically charged to the same payment card 24 hours before the scheduled start of the trip.
If the booking is made less than 24 hours before the trip, the full amount may be charged immediately.
The reservation becomes valid only after acceptance by the Operator. If rejected, the deposit is automatically refunded to the User.
5. Cancellations and Refunds
If the User cancels the reservation at any time, the 10% deposit is non-refundable. No further charges will be applied.
If the Operator cancels the trip (e.g., due to bad weather or technical issues), the User will receive a full refund of the deposit, automatically and without the need to submit a request.
The Operator may offer an alternative date. The User has the right to accept or decline the change.
6. Scope of Responsibility
The Service Provider is solely responsible for the proper functioning of the platform, processing of payments, and support for the reservation process.
The Service Provider is not responsible for the quality, safety, or execution of the trip, which is fully managed by the Operator.
The Operator is fully responsible for:
the technical condition of the vessel,
legal and safety compliance,
provision of a licensed skipper,
execution of the service as per the confirmed booking.
The User is responsible for their behavior during the trip and for any damage caused to the boat or others.
7. Force Majeure
Neither party shall be held liable for non-performance due to force majeure — extraordinary events beyond reasonable control (e.g., natural disasters, government actions, port closures, war, epidemics).
8. Data Protection and Privacy
The controller of personal data is Adam Sieczkowski Software.
User data is processed in accordance with Regulation (EU) 2016/679 (GDPR).

9. Complaints and Disputes
Any complaints related to the technical operation of the platform may be submitted to: booking@dinghyfleet.com
Complaints related to the trip itself must be addressed directly to the Operator.
DinghyFleet may assist informally in facilitating communication, but is not liable for the resolution of disputes.
10. Final Provisions
The Service Provider reserves the right to modify these Terms of Service. Updated versions will be published on the website.
These Terms shall be governed by the laws of Poland.
All disputes shall be resolved by a competent court with jurisdiction over the registered office of the Service Provider in Poland.
